Terms and Conditions for membership to DiploNews.com ("The Service")

DiploNews.com (The Service) is an online information service published by CYCEON SARL ("DiploNews"). By using the Service, ("the Subscriber") you agree to the Terms and Conditions for a membership to DiploNews.com. Please read the Terms and Conditions carefully. DiploNews may revise the terms in this Agreement at any time. By using the Service after any change in the Agreement is posted, you agree to be bound by all of the changes.

The Subscriber is responsible for complying with the Terms and Conditions. Any violation of the Terms and Conditions may jeopardize future use of the Service, and upon any such violation, such account may be subject to immediate suspension or termination by DiploNews as determined in its sole discretion.

Section 1. Copyright and Limitations

1.1 Under the terms of a membership to DiploNews.com, access to DiploNews and DiploNews.com content, services or tools, and other intelligence features is for the Subscriber ONLY and may not be shared. The Subscriber is responsible for the confidentiality and use of the Subscriber's user name and personal password. The Subscriber's responsibility extends to all activity and use under the user name and password. By purchasing a membership to DiploNews.com, you agree not to reproduce, retransmit, photocopy, distribute, disseminate, sell, publish, broadcast, or circulate the information received through the Service to anyone without the express prior written consent of DiploNews. Information abstracted from our intelligence can be used for research purposes but not for commercial purposes. Copying and distributing original copyright-protected intelligence from the site is expressly forbidden.

1.2 The Subscriber agrees to provide complete and accurate account information. It is the sole responsibility of the Subscriber to report any changes to DiploNews Customer Service department immediately. Further, if it is determined that the information provided is inaccurate or incomplete, DiploNews reserves the right to suspend or terminate the account until such information is corrected by the Subscriber.

1.3 The information available through the Service is the property of DiploNews or its licensors, and is protected by copyright and other intellectual property laws. Information received through the Service is for the Subscriber's use only. Only 'Personal' and 'Professional Accounts' of Corporations, enterprises, organizations or other commercial entities are authorized to use the Service under these Terms and Conditions. However, Multiple and/or Professional Accounts also are bound by these terms of use except if special terms have been defined by a written agreement between DiploNews and specific Corporations, enterprises, organizations or other commercial entities.

1.4 Subscribers may not post any intelligence from the Service to newsgroups, mail lists, or electronic bulletin boards, without the prior written consent of DiploNews.

1.5 DiploNews reserves the right to monitor the Subscriber's use of all intelligence, services, and tools to ensure the Subscriber's compliance with the Terms and Conditions. If it is determined that the Subscriber is not in compliance with these Terms and Conditions, DiploNews reserves the right to take such action as is deemed necessary, including, but not limited to, suspension or termination of the Subscriber's account. The Subscriber acknowledges that such monitoring of use may include determining whether or not the Service is accessed under the account from multiple IP addresses, as well as noting excessive use from DiploNews.com accounts.

1.6 The Service includes facts, views, opinions, and recommendations of individuals and organizations deemed of interest. DiploNews does not guarantee the accuracy, completeness, or timeliness of, or otherwise endorse, these views, opinions, or recommendations, give investment advice, or advocate the purchase or sale of any security or investment.

Section 2. Disclaimer of Warranties and Liability

2.1 Due to the number of sources from which information on the Service is obtained, and the inherent hazards of electronic distribution, there may be delays, omissions, or inaccuracies in such information and the Service.

2.2 CYCEON SARL/DiploNews AND ITS AFFILIATES, AGENTS, AND LICENSORS CANNOT AND DO NOT WARRANT THE ACCURACY, COMPLETENESS, CURRENTNESS, NONINFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE OF THE NEWS AND INFORMATION AVAILABLE THROUGH THE SERVICE, OR THE SERVICE ITSELF. NEITHER CYCEON SARL/DiploNews NOR ANY OF ITS AFFILIATES, AGENTS, OR LICENSORS SHALL BE LIABLE TO THE SUBSCRIBER OR ANYONE ELSE FOR ANY LOSS OR INJURY CAUSED IN WHOLE OR IN PART BY ITS NEGLIGENCE OR CONTINGENCIES BEYOND ITS CONTROL IN PROCURING, COMPILING, INTERPRETING, REPORTING, OR DELIVERING THE SERVICE AND ANY NEWS AND INFORMATION THROUGH THE SERVICE. IN NO EVENT WILL CYCEON SARL/DiploNews, ITS AFFILIATES, AGENTS, OR LICENSORS BE LIABLE TO THE SUBSCRIBER OR ANYONE ELSE FOR ANY DECISION MADE OR ACTION TAKEN BY THE SUBSCRIBER IN RELIANCE ON SUCH INFORMATION, OR FOR ANY CONSEQUENTIAL, SPECIAL OR SIMILAR DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE SUBSCRIBER AGREES THAT THE LIABILITY OF CYCEON SARL/DiploNews , ITS AFFILIATES, AGENTS, AND LICENSORS, IF ANY, ARISING OUT OF ANY KIND OF LEGAL CLAIM (WHETHER IN CONTRACT, TORT, OR OTHERWISE), IN ANY WAY CONNECTED WITH THE SERVICE OR THE INFORMATION IN THE SERVICE, SHALL NOT EXCEED THE AMOUNT THE SUBSCRIBER PAID TO CYCEON SARL/DiploNews FOR USE OF THE SERVICE.

2.3 DiploNews may discontinue or change the Service, or its availability, at any time without notice. The Subscriber's rights and obligations under this Agreement are not assignable. If any provision of this Agreement is invalid under applicable law, the remaining provisions will continue in full force and effect. This Agreement, all intellectual property issues, and your rights and obligations shall be governed by the laws of France and international laws.

Section 3. Payment Policies

3.1 DiploNews.com -- Free Trial:

One can ask for a free trial period during which the user can partly or fully access the service. Login information following a request for a free trial is strictly personal. Any multiple use or sharing of such information would lead to immediate account's termination. If you belong to a company, government, ministry, diplomatic mission, organization, news agency, library please contact us.

3.2 DiploNews.com -- General:

You understand that you are purchasing a membership to DiploNews.com and agree to the terms and conditions. You also understand that your membership will be automatically renewed unless your contact customer service to cancel.

3.3 DiploNews.com -- Membership

An individual email address is required. Using professional email address is not possible. Personal Membership means your subscription is for personal purpose. It limits your access to the archives of the last 3 months. If you need full access to all the archives, you need a Corporate/Institutional Membership, please contact us.

3.3 DiploNews.com -- Membership: Yearly

Accounts are prepaid on an annual basis and may be paid by credit card only (except for multiple and/or professional accounts). Activation begins upon payment. Unless otherwise notified by DiploNews, your credit card account will be automatically charged each year on the anniversary of your subscription. At that time, you will be renewed at the then current rate, unless you notify us of your desire to cancel your subscription at least thirty (30) days prior to the renewal date.

3.4 DiploNews.com -- Membership: Monthly and Quarterly

Accounts are prepaid on an Monthly or Quarterly basis depending on the membership you chose and may be paid by credit card only (except for multiple and/or professional accounts). Activation begins upon payment. Unless otherwise notified by DiploNews, your credit card account will be automatically charged each Month or Quarter on the anniversary of your subscription. At that time, you will be renewed at the then current rate, unless you notify us of your desire to cancel via your account's profile.

3.5 DiploNews.com -- Limitation of the Membership

ONE membership is for ONE USER exclusively. Professionals (states, ministries, embassies, companies, organizations, universities, libraries) must contact us to be granted access to our service through a Professional membership. If your use of the product does not comply with a ONE USER membership, your account will be automatically suspended without any possibility of refund and during an indeterminate period of time. In the event of any subsequent violation of the terms and conditions, your account will be terminated without any possibility of refund. Also, additional restrictions or suspensions of access might be applied to all the memberships of the institution/company/organization you connected from. Any access from a state institution using a personal membership may restrict or suspend the membership of several and/or any state institutions in the country during an indeterminate period of time. In case of any subsequent violation of the terms and conditions, CYCEON SARL reserves the right to prohibit any access to the service which would originate from this same country during an indeterminate period of time.

3.6 DiploNews.com -- Full Edition (Professional User Membership)

One can get full access to all the archives by subscribing to a Corporate/Institutional Membership of which fees and conditions are specific to each customer depending on the number of (multiple) users, online traffic and specific needs. If you, your company or your institution is interested in such a membership, please contact us.

Section 4. Cancellation Policies

4.1 If a subscription is active, it's active for at least 12 months from the moment you subscribed. Then, to cancel your membership to DiploNews.com, you notify us of your desire to cancel your subscription at least thirty (30) days prior to the renewal date for annual subscription by sending an email entitled “Subscription Cancellation Request” to contact@diplonews.com. Please be sure to provide your name, address, phone number, e-mail address, user name and password for authentication, and the reason you want to cancel. Cancellations are processed upon receipt of the cancellation request.

4.2 DiploNews.com -- Annual subscription: Upon cancellation, annual accounts will be charged only for the year of service during which the account was active. All fees and charges are nonrefundable for an Annual (or any Monthly / Quarterly / Home User / Professional User) subscription.

Section 5. Privacy Policy

5.1 DiploNews is committed to protecting your privacy. Information that we collect stays within DiploNews and any information distributed to third parties is reported in aggregate only. We do not give or sell your information. For more information, please read the full text of our Privacy Policy.
